So I had a 2007 Speed 3. I saw on eBay that dabears was selling a TWM Short shifter. I got it in March and never got around to installing it on my vehicle. So when I sold the car, I sold everything. So I sell the shifter to a forum member and he tells me that TWM is telling him that the shifter that dabears sent me and I sent to him is a fake. So the forum member took pictures and sent them to TWM and they told him this:

Hi Rick,

This is not a TWM short shifter. If you can give me your email address, I can send you some pictures for a comparison to file a complaint against this vendor. By the way, is it possible to know where you bought this shifter from?

Thanks,

Frank
Team TWM Performance

So after seeing this, I was a bit ticked off because of the problem. The buyer was not angry at me since it was not my fault that dabears sent me a part that was not what was listed. So after that, I sent dabears a message stating this:

ear idj4uljdj,

I purchased a short shifter from you guys for my 07 Mazdaspeed 3. I have not installed it yet. I did find out that you are selling fake TWM Short Shifters. I would like to have my money back. If you do not issue me a refund, I will notify the proper authorities in California about you scamming people with parts that not what they are. TWM told me that you are not a registered seller and that you have been selling these to people telling them that this is a TWM Shifter. For such a small company, I think you really need to get into line about the buisness you are in and think about others before making a sale to someone that is not a true item. I want my money back, you can have the part back. If I do not have my refund in my account by tommorow, I will be contacting the attorneys office in California and a lawsuit may be at stake if that is what it takes to get my money back. I have proof from TWM that this is not there make. You can tell the difference.

Here is what they told me:
Dear racinhartchic,

Perhaps you have never heard the old adage that you catch more flies with honey than with vinegar. A simple request for money back would have sufficed. The rest of your post just makes you look ignorant. In any case, please send it back for a full refund (which is the same response you would have gotten with just a simple request for return).

- idj4uljdj

Heres what I sent back:
Dear idj4uljdj,
Perhaps, but I'm not the ignorant one that sells things that say this
when there really not. Where do I send it to?

-racinhartchic

I guess I got a bit carried away, but spending money on something these days and not getting what you paid for is defiantly a crappy way to do business. I would advice people that have bought "TWM short shifters" from dabears in the past, or anyone buying from the company again, to really think about who your buying it from since this business is shady. Im not bashing them, but just want people to be cautious about ordering from them.

Mods, if I posted this in the wrong section, please move the post to the right location.

Thanks

I'm almost willing to bet that once you send the shifter back, you won't get a refund and you won't hear from them again.

Y'know, I was thinking the exact same thing when I was reading this.

+1, then you won't have any evidence, either.

I'm surprised they are even giving you a refund. I know that there are several people who are not so lucky with this vendor. >_<

Bring up legal action and most people will just give you a refund.

He has pictures of the shifter, a letter from TWM stating it's not authentic, and he will have a tracking number showing when he shipped a package weighting the correct weight of the shifter back to them. I'd say that's enough proof and he will get his refund.

x2. And don't threaten to sue. Empty threats don't work and the owner will know it'll cost more for a lawyer than it will for the right part. If anything I'd threaten to call the attorney general's office. And if they don't do what they are supposed to, actually call them. If a customer threatens to sue me..whether I am right or wrong I no longer wish to deal with their dumb asses anymore and they now get nowhere.

2563 OLD QUARRY RD #804
SAN DIEGO, CA 92108 IS THE EMAIL ADDRESS HE SENT ME.

YEA I WAS THINKING ABOUT THE SENDING THE PART BACK AND THEN NOT GETTING A REFUND. IT JUST PUZZLES ME THAT SOMEONE WOULD DO SOMETHING LIKE THIS WHEN THEY ARE A SMALL BUSINESS IN THE FIRST PLACE AND GET THERE NAME CALLED OUT LIKE THAT. I CAN TELL YOU ONE THING, I WILL MAKE SURE I RESEARCH STUFF BEFORE I DO BUSINESS WITH THEM AGAIN. I WILL SAY THOUGH, I DIDN'T KNOW IT WAS DABEARS UNTIL I PAID FOR THE SHIFTER THROUGH PAYPAL.

selling fake parts on ebay and having him fraud hundreds of customers could lead to a big lawsuit and his account being frozen until reimbursement is issued and his life going to shit. this isnt just a defect in a toy at walmart, these are fake parts being sold by the hundreds in a business marketplace to consumers who wouldnt really be able to tell the authenticity of the part.

I am a new vendor on this forum so I understand I don't have as much credibility on this subject as some other vendors do (yet) but I just wanted to give everyone my take. Bottom line is that it's unfortunate that you have to do research to find someone who you want to work with to buy parts. Doing research on a company isn't what most people want to do when looking for go fast parts but it's necessary.

However, placing a call to or exchanging some messages with the person you are potentially doing business with can really help. Most people you shouldn't do business with will not treat you like a wanted customer. Crooks want easy money. Good vendors are willing to work hard for their customers and their reputation. That's the biggest difference.

I'm very sorry to hear about this situation. It totally stinks that this kind of stuff even happens.

THANK YOU for telling people about your situation. Although you got the short end of the stick, you are helping all who read this and allowing them the opportunity to learn that they need to do the proper research before making a purchase.

I strive every day to make sure I'm taking care of my customers in every way possible. Starting a business and growing it is more difficult than most people know so it can be hard every once in a while. But a good business will always do the right thing. I know this is my top priority. I can have a warehouse full of parts but if I don't have a single person to sell them to...I'm out of business. It's all about the people.

Do your research on who's a good vendor and who's not. You will find it without too much work.

If you want a shortcut to a good vendor...you can always come to Edge Autosport!!! : )

I did all this and they still didn't refund me. I also don't have means to chase after them. I was very polite and cool headed and never got a response. I wish it was something cheap like a short shifter but it wasn't.
